India may impose anti-dumping duty on Straight Length Bars & Rods of Alloy Steel from China. Directorate General of Trade Remedies announced “The Authority notes that the investigation was initiated, and it was notified to all the interested parties. Adequate opportunity was given to the exporters, importers and other interested parties to provide information on the aspects of dumping, injury and causal link. Having initiated and conducted an investigation into dumping, injury and the causal link thereof in terms of the anti-dumping Rules and having established positive dumping margin as well as material injury to the domestic industry caused by such dumped imports, the Authority is of the view that imposition of anti-dumping duty is necessary to offset dumping and injury. Having regard to the lesser duty rule, the Authority recommends imposition of definitive antidumping duty equal to the lesser of margin of dumping and margin of injury, so as to remove the injury to the domestic industry. Accordingly, the Authority recommends imposition of anti-dumping duty equal to the amount indicated in Col 8 of the table below on the imports of the subject goods, originating in or exported from China PR from the date of notification to be issued in this regard by the Central Government for period of 5 years. However, no antidumping duty shall be payable on imports of forged bars and tool & die steel (other than grades of tool & die steel excluded from the scope of PUC) if their landed value is above USD 659.91/MT. If the landed value of forged bars and tool & die steel (other than grades of tool & die steel excluded from the scope of PUC) is lower than USD 659.91/MT, then the difference between such landed value and USD 659.91/MT shall be payable as anti-dumping duty.”

NOTE 1: Alloy bars and rods in straight length, whether or not hot rolled, hot drawn, cold drawn, cold extruded, peeled bar. surface machined, polished, bright bar. forged. However, the PUC excludes the following:
1. Bars and rods in irregularly wound coils;
2. High Speed Steel i.e. alloy steels containing, with or without other elements, at least two of the three elements namely Molybdenum (Mo), Tungsten (W) and Vanadium (V) with a combined content by weight of 7% or more, 0.6% of more of Carbon and 3% to 6% of Chromium:
3. Tool and Die Steel: This category covers steel having either of the following three combinations:

NOTE 2: No anti-dumping duty shall be payable on imports of forged bars and tool & die steel (other than grades of tool & die steel excluded from the scope of PUC in Note 1) if their landed value is above USD 659.91/MT. If the landed value of forged bars and tool & die steel (other than grades of tool & die steel excluded from the scope of PUC in Note 1) is lower than USD 659.91/MT, then the difference between such landed value and USD 659.91/MT shall be payable as anti-dumping duty.
JSW Steel Limited, Jayaswal Neco Industries Limited, Sunflag Iron & Steel Co Limited, Usha Martin Limited, Gerdau Steel India Private Limited and Vardhman Special Steels Limited had jointly filed an application before the Designated Authority in accordance with the Act and the AD Rules, for initiation of antidumping investigation concerning imports of “Straight Length Bars & Rods of Alloy Steel”, originating in or exported from China PR
